Yes, it is illegal. And yes, you are correct - it's not because of the composer's rights, it's because of the performer's download classical music mp3rights.
Downloading a Pavarotti performance is just as wrong ethically as downloading a Britney Spears performance. And the same goes for instrumental works - orchestras are performers too.
The point you raise is why so many pieces of classical music are used in movies, TV shows, commercials... The producers don't have to pay for download classical music mp3the composition of these pieces, just the performance - so it's cheaper!
The notion of copyright didn't even exist until the middle of the 19th century. However individual recordings might be copyrighted.
